Lenovo Van for Life Volunteer Opportunity Program

(“Promotion”) Terms and Conditions

Promotion Overview: Lenovo and BirdLife International (a non-profit non-governmental organization) (“NGO”), are looking for individuals who are able to work remotely, to apply as volunteers (“Volunteers”) to live and drive in Lenovo and BirdLife’s van for up to seven days, during the period from June 15, 2023 through July 30, 2023. Lenovo Group Limited and/or its subsidiaries (collectively “Lenovo”) is supporting BirdLife in their efforts to expand the data collection of bird song in North America. Volunteers selected by Lenovo and BirdLife to participate in the Promotion are expected to continue working their existing day jobs in the Lenovo van, and also drive on a predetermined route. Lenovo is not a part of the Volunteer selection committee and will be released from any liability related with this Promotion. 

Volunteers Overview: We are looking for four (4) Volunteers with the ability to work their existing jobs remotely to volunteer with BirdLife, driving and living in a van for up to seven days. Volunteers have the ability to bring one (1) guest (“Guest”) on the trip. 

If chosen, Volunteers (and their Guests) will live and drive in the van for up to seven (7) days. Flights and a stipend for food will be provided. As a volunteer, we’ll ask you to help us capture content for up to 30 minutes per day for the seven days. 

  1. Promotion Application PeriodThe application period for the Promotion will begin at 12:00 a.m. ET on April 27, 2023 and ends at 11:59 p.m. ET on May 17, 2023 (the “Promotion Period”).

  2. Eligibility: Open to legal residents of the 48 contiguous United States and the District of Columbia (excluding Alaska and Hawaii) who are 25+ years of age as of date of application submission, who are employed full-time (defined below) and who have a valid U.S. driver’s license and a valid U.S. passport to travel through December, 2023, Employees, officers, and directors of Lenovo Group Limited (“Sponsor“), Zeno Group Inc., BirdLife, Don Jagoda Associates, Inc., and any of their respective parents, affiliates, subsidiaries, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment, and marketing agencies, web site providers, web masters (collectively, the “Sponsor and its Administrators”), and members of their immediate families (spouses, parents, siblings and children, regardless of where they live) and those living in the same household (whether or not related) are not eligible to enter or win. Participation constitutes applicant‘s full and unconditional agreement to these Terms and Conditions (“Terms”) and to Sponsor and its Administrators decisions, which are final and binding in all matters related to the Promotion. All applicable laws and regulations apply.Employed full-time definition: For the purposes of this Promotion, a full-time employee is defined, for a calendar month, an employee employed on average at least 30 hours of service per week, or 130 hours of service per month and able to work remotely.

  3. How To Apply: During the Promotion Period, applicants (each, an “Applicant” and collectively the “Applicants”) may apply by visiting www.lenovowfh.com (the “Website”) and completing all required information on the Website and application form, including a brief paragraph of 200 words or less that describes why you are the ideal candidate to travel and engage in selected activities/requirements remotely in a Lenovo technology-enabled van (“Entry”). In your essay, you must include how you can work your current job remotely. Limit one (1) Entry per person/email address. Applications must be in English. Any Application not in compliance with these Terms will be disqualified. All Applications must be the sole, original work of the Applicant. Applicants warrant that all information and materials contained in the Application belong to the Applicant, and the Application does not infringe, misappropriate or violate the rights of any third party including, but not limited to, copyright, trademark, or other intellectual property rights, rights of publicity or privacy or defamation, or portrayal in a false light. Any Application not in compliance with the above or that otherwise does not meet the Promotion requirements will be disqualified. The Applicant must be an individual person and not a group of people or an organization. Automated, script, macro or robotic Applications will be disqualified. Applications must be submitted by one Applicant only and Applicants are not permitted to create a team and submit an Entry together. Duplicate applications will automatically be disqualified. Proof of submission will not be deemed to be proof of receipt by Sponsor. Use of any automated or computer system to participate is prohibited and will result in disqualification. All Applications become the property of the Sponsor and must be received between 12:00 a.m. ET on April 27, 2023 through 11:59 p.m. ET on May 21, 2023. In the event of a dispute as to the identity of an Applicant, the authorized account holder of the email address provided at time of application will be deemed to be the Applicant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider, Internet service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential Applicant may be required to show proof of being the authorized account holder. Applications specifying an invalid, non-working, or inactive email address may be disqualified and deemed ineligible to participate. No information regarding Applicants, other than as otherwise set forth in these Terms or on the Website, will be disclosed. By participating, Applicants agree to these Terms and the decisions of the Sponsor, which shall be final and binding in all respects.

  4. Application Review Process and Notification of Volunteers: All eligible Applications will be reviewed by Sponsor-specified panels of judges (the “Reviewers”) to determine the top eight (8) Entries based on the following judging criteria: Adherence to Promotion theme (essay accurately and clearly communicates why you are the ideal candidate) (50%); Originality & Creativity (25%); Description of how you can do your present job remotely (25%). The top eight (8) Applicants will be referred to as the Finalist candidates (“Candidates”) and will be asked to participate in an interview with select Reviewers to take place over a Zoom video chat or such other online meeting platform designated by the Reviewers (the “Interview”) and the Interviews will be property of the Sponsor. Candidates will be notified in advance via email/phone to schedule the Interview. Reviewers will determine date/time and duration of Interview. Failure of a Candidate to respond within twenty-four (24) hours of notification attempt or failure to participate in the Interview (including on camera video) during the scheduled time will result in the Candidate being disqualified from further review. All eligible Candidates will be evaluated based on their Application and Interview and the judging criteria above, and four (4) Candidates will be determined as the Volunteers and be invited to participate in the Volunteer Opportunity, subject to verification of qualifications.

    The selected Volunteers will be contacted via email and required to complete and sign a Declaration of Eligibility, liability/publicity release and assignment of rights and Independent Contractor Agreement (“Declaration Documents”) prior to being confirmed a Volunteer. The Declaration Documents will be sent to the email address submitted at time of application. Potential Volunteers must sign and return Declaration Documents via email/DocuSign link within forty-eight (48) hours of notification attempt or Entry may be forfeited and an alternate Candidate may be determined, time permitting. Return of any notification as undeliverable may result in disqualification and alternate determination, time permitting. Volunteers’ Guests must be 25+ years of age and sign and return a Release of Liability and a Publicity Release (“Release”) prior to travel (as applicable).

    Sponsor and its Administrators reserve the right to conduct a background check on the four (4) potential Volunteers and their respective Guests prior to confirming official Volunteer/Guest status. The Sponsor reserves the right in its sole discretion to disqualify a Volunteer and/or Guest based on the results of such background check, if Sponsor determines that awarding a prize to such potential Volunteer might reflect negatively on Sponsor or any of its businesses. Factors that may result in disqualification for the potential Volunteer/Guest include, without limitation, a potential Volunteer/Guest having been convicted of a felony, being delinquent on a government ordered payment, such as child support, spousal support, alimony, or tax payments or public social media accounts that do not align with Sponsor’s image. Volunteers’ and Guests’ social media accounts must also be aligned with Sponsor’s image and not deemed offensive, in Sponsor’s sole discretion or Applicant may be disqualified.

    Prospective Volunteers/Guests must (i) meet any restrictions established by any government or government agency, campsite, or Sponsor, (ii) pass any medical tests or other requirements at any time required or recommended by any government agency, campsite, or Sponsor, including without limitation, passing one or more COVID-19 antigen and screening tests and testing negative for COVID-19; (iii) provide documentation of COVID-19 vaccine(s) and (iv) execute any assumption of risk or other documents relating to COVID-19 or the Volunteer/Guest may not be able to participate.
    By participating in the Application process, Applicants/Candidates/Volunteers agree to the Terms and the decisions of the Reviewers, which shall be final and binding in all respects. All Candidates also agree to all portions of the vetting process, including, but not limited to, Interviews, the above mentioned background check, passport and driver’s license verification.
     
  5. Volunteer Opportunity: The four (4) Volunteers and their respective Guests will travel to a pre-determined by Sponsor-selected airport to meet the Lenovo Van for Life ground team (“Ground Team”) on the dates specified by the Sponsor between June 15, 2023 through July 30, 2023. From there, Volunteers will travel on a Sponsor-specified pre-determined route with stops at specific campsites for overnight stays. Along the journey, Volunteers will follow instructions to turn on Lenovo technology to record birdsong. Volunteers will also help capture content of the van and the bird habitat for up to 30 minutes each day. Volunteers will be able to work at their current full-time job remotely from the van, utilizing Lenovo technology. Volunteer is able to bring a Guest to travel with but the Guest must also meet the requirements of the Promotion. At the end of the trip, the Volunteer will return the van to a Sponsor-specified location on Sponsor-specified date and time and will then be met by the Ground Team and be transported to a Sponsor-specified airport for the return trip to their home airport.

    The Volunteer Opportunity includes:

    • Round-trip economy class air transportation for Volunteer and one (1) guest from a major airport nearest Volunteer’s home to a Sponsor-specified airport.
    • Accommodations in the Lenovo Van for two people (one shared double sized bed).
    • $2,000 awarded as gift cards to the Volunteer to be used for gas and food for full seven-day trip.
    • Use of the Lenovo technology in the van.
    • All other expenses and costs not expressly listed in these Terms are each of the Volunteer’s sole responsibility, including travel to/from home airport.

    The approximate retail value (“ARV”) of the Volunteer Opportunity is $5,800 each. Terms and conditions on gift cards including any expiration dates apply. Limit one Volunteer Opportunity per person/household.  Volunteers will be issued a 1099 tax form for the actual retail value of their Volunteer Opportunity.

  6. Volunteer Requirements: Volunteers are responsible for obtaining travel documents (i.e., Government-Issued ID and “valid passport” valid until at least December 1, 2023) as well as travel insurance (and all other forms of insurance), that they may need to obtain for travel (at their own expense) and hereby acknowledge that the Sponsor and its Administrators have, nor will, obtain or provide travel insurance for the Volunteer Opportunity. In the event of any unforeseen or force majeure event (including without limitation epidemic, pandemic, communicable, contagious, or infectious disease or public health quarantine that impacts the Promotion or travel), travel may be unable to take place and the Promotion and Volunteer Opportunities may be cancelled.

  7. General Conditions/Assignment of Rights: As a condition of Application into the Promotion, all Applicants agree to release the Sponsor and its Administrators, each of their respective agencies, parents, subsidiaries, affiliated companies and each of their respective officers, directors, shareholders, members, employees, agents, assigns, and all others associated with the development and execution of this Promotion from and against any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with submitting an Application (as applicable) or otherwise participating in any aspect of the Promotion; the participation in the Volunteer Opportunity; the receipt, use or mis-use of any technology (including any failure of equipment or services provided in the Lenovo Tech Space); or any typographical or other error in these Terms or offering of an Interview of Volunteer Opportunity.

    Each Applicant grants to Sponsor a worldwide, royalty-free, perpetual and non-exclusive right and license to use, copy, distribute, reproduce, modify, adapt, edit, translate, publicly perform and publicly display and create derivative works from and display each submitted Entry and content submitted during the Volunteer Opportunity, if applicable in any media, and with right to use, copy, modify, edit, and create derivative works there from, and agrees to waive any and all moral rights that the Applicant may have in the Entry and content with respect to the uses contemplated herein, and to execute documents confirming such right and license at Sponsor’s reasonable request.

    By accepting and participating in the Volunteer Opportunity, each Volunteer represents that such participation complies with the Code of Conduct and other corporate policies of the current employer of such Volunteer. Selected Volunteers may be required to provide written consent from their current employers in order to engage in the Volunteer Opportunity. Further, by accepting and participating in the Volunteer Opportunity, each Volunteer grants to the Sponsor and its Administrators permission to use his/her/their name, likeness, biographical information, quotes, voice and other indicia of identification, as well as the contents of his/her/their Application and any content submitted for PR and promotional purposes in any and all media now known or hereafter developed, without any limitation to time, media or jurisdiction, without compensation except where prohibited by law. By applying, each Applicant accepts and agrees to be bound by these Terms. In the event of a dispute, Applications will be declared to be made by the person named in the application form, regardless of the authorized account holder of the e-mail address submitted at the time of application. The Released Parties are not responsible for technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications, whether caused by the sender, by any of the equipment associated with or utilized in this Promotion which may limit the ability to participate, or by any human error which may occur in the processing of the Applications in this Promotion. Applications generated by script or bot are not eligible. Lenovo and NGO reserve the right to cancel, terminate or modify the Promotion if it cannot be completed as planned for any reason, including but not limited to for infection by computer virus, bugs, tampering, unauthorized intervention, technical failures or corruption of any sort or if there are an insufficient number of Applications. In the event that there are an insufficient number of qualified Applicants, as determined by the Reviewers, there may be no Candidate or Volunteer determined or less than four (4) may be determined. Further, Reviewers reserve the right in their sole discretion to immediately remove Volunteers/Guests from the Volunteer Opportunity at any time if Reviewers believe a Volunteer’s/Guest’s conduct is disruptive, inappropriate, violent, illegal, derogatory of any ethnicity, race, gender, religion, sexual preference, disability or age group, or is obscene or otherwise offensive.

  8. Privacy: Information, including personal data, collected in connection with this Promotion may be used and retained by the Sponsor and its Administrators in the administration of the Promotion in accordance with these Terms, the privacy notice posted to the Site, and the online privacy statements published at https://www.lenovo.com/us/en/privacy/ and https://www.djeholdings.com/privacy-policy. Any personal information that you provide in connection with the Promotion shall be used to run this Promotion, contact Applicants, and for the other purposes set forth in the privacy statements referenced above, and in conjunction with applicable privacy and data protection laws (including, but not limited to, the European Union’s General Data Protection Regulation). Your personal data and additional application information may be transferred across borders and shared with third parties who will support this Promotion, such as background screening, travel services, and healthcare and insurance providers. Pursuant to any applicable law and the privacy statements referenced above, you have the right to review, correct, amend, and/or delete your personal data. You may also have the right of opposition to the data collection, under certain circumstances. To exercise such rights, you may contact the Sponsor and its Administrators and exercise your data protection rights by following the instructions in the privacy statements referenced above.
